TIMES 75TH ANNIVERSARY SCRATCH-OFF CARD GAME (“GAME”) OFFICIAL RULES

 

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN OR CLAIM PRIZE. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. GAME BEGINS OCTOBER 16, 2024 AND ENDS NOVEMBER 12, 2024 OR WHEN GAME CARD SUPPLIES ARE EXHAUSTED (WHICHEVER OCCURS FIRST).

1.ELIGIBILITY. This Game is open only to individuals who are legal U.S. residents of Hawaii and eighteen (18)years of age or older at the time of participation. Void outside Hawaii and where prohibited or restricted by law. Employees, contractors, officers and directors of Times Supermarkets (“Sponsor”), its parent company, subsidiaries, divisions, suppliers, distributors, participating locations (including Big Save Hawaii and  Shimas), and Sponsor’s advertising and promotional agencies (collectively, the “Game Entities”) and members of the immediate families (spouse and biological, adoptive or step-parents, grandparents, children, grandchildren and siblings, and each of their respective spouses regardless of where they reside) or households (whether related or not) of any of the above individuals are not eligible to participate in the Game or win a prize or redeem a reward. The Game is subject to all applicable federal, state, and local law and regulations. By participating in the Game, each participant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of the Sponsor, which shall be final and binding in all respects.

2.HOW TO PLAY. There are two (2) ways to play: 

A. MAKE A QUALIFYING PURCHASE: Between October 16, 2024 and November 12, 2024, visit a participating Times Supermarket (“Times”),Big Save Hawaii, or Shimas location and purchase $40.00 or more in products at the store (excludes alcohol, tobacco, electronic products, gift cards, pharmacy, bus pass and postage stamp sales), in a single transaction, to receive a Game Card from the checkout clerk, while supplies last. Please visit www.timessupermarkets.com for list of store locations. Limit one (1) Game Card per day per person.

B. NO PURCHASE NECESSARY: To request a Game Card without making a purchase, while supplies last, mail a self-addressed, first-class stamped envelope to: Times Supermarket, 801 Kaheka Street, Honolulu Hi 96814, ATTN: Times 75th Anniversary Game Card Request. Limit one (1) request per stamped-outer-envelope per person/household per day. Requests must be postmarked by November 12, 2024 and received by November 15, 2024 and will not be returned. Illegible requests will be discarded and deemed void. No facsimile or copies will be allowed. Times will not be responsible for lost, late, insufficient postage, misdirected handling, incomplete requests or any errors due to postage and handling. Requests honored while supplies last.

Upon receipt of your Game Card, scratch off the area indicated to determine if you are a prize winner(subject to verification).Non-winning Game Cards may contain a reward. See Section 5 for details regarding prizes and rewards.

3.PRIZE/REWARD REDEMPTION. Prize reward redemption is applicable to in-store transactions and excludes all on-line purchases. All prizes and rewards are subject to terms and conditions as stated on the Game Card. All prizes must be claimed, as indicated on the winning Game Card, by November 19, 2024.Rewards must be redeemed as stated on the Game Card. The submission of a prize claim is solely the responsibility of the participant. Use of a prize or reward is soley the responsibility of the participant. You may keep a copy of the winning Game Card for your records, however, an original Game Card is required to redeem a prize or reward. No pictures, photocopies, facsimiles other forms of proof of a winning Game Card will be allowed. Prize claims are subject to eligibility and verification by Sponsor or its fulfillment partners, whose decisions are final. Limit one (1) prize claim per winning Game Card.The Released Parties (as defined below) are not responsible for lost, illegible, damaged, stolen or mutilated Game Cards, regardless of cause. 

In addition to presenting an original Game Card to claim a prize, prize claimants may be required to show a valid government-issued photo ID and sign and return an affidavit of eligibility and liability/publicity release and/or a prize-claim form to verify their eligibility and claim a prize. If a potential winner (a) cannot be verified as eligible; (b) fails to provide signed affidavits or releases or other required forms; (c) fails to present a proper identification at the time of claiming a prize or fails to collect or properly claim any prize in accordance with these Official Rules and as stated on the Game Card; (d) declines the prize; (e) is disqualified for any reason; or (f) is not unable to accept the prize as stated, the prize may be forfeited, in Sponsor’s sole discretion.

4. GAME CARD VERIFICATION. All potentially winning Game Cards are subject to verification. Anti-fraud detection devices may be used to verify prize winners. Game materials and Game Cards are void if not obtained through authorized, legitimate channels, or if any part is defective, altered, duplicated, photocopied, forged, counterfeited, mutilated or tampered with in any way, or if Game materials or Game Cards contain or are the result of a printing, seeding, typographical, mechanical or other error(s), or do not contain proper security devices. No prizes will be awarded to the holder of a void Game Card and the sole liability for an irregular official Game Card is limited to replacement with a free randomly selected official Game Card, while supplies last. All submitted Game materials/Game Cards become the property of the Sponsor, and will not be returned. No more than the stated number of prizes set forth in these Official Rules will be awarded. In the event that production, seeding, printing or mechanical or other errors or any other reasons cause more than the stated number of prizes, set forth in these Official Rules, to be available and/or claimed in any prize category, Sponsor reserves the right to conduct a random drawing to award the advertised number of prizes set forth in these Official Rules.

5.PRIZE/REWARD DETAILS. See below for prize details and all prize conditions. Additional information regarding a prize will be provided to confirmed winners upon redemption and verification of their Game Card.

No cash alternative or transfer or substitution of any prize or reward will be allowed, except Sponsor reserves the right to substitute a prize of comparable value if a prize listed is unavailable for any reason. If for any reason a reward cannot be redeemed, Sponsor shall have no further obligation to the reward recipient. Unclaimed prizes and rewards will not be awarded. Any difference between stated value and actual value of a prize will not be awarded. Prize winners/reward recipients shall be solely responsible for all federal, state and/or local taxes, and the reporting consequences thereof (if any), and for any other fees or costs associated with the applicable prize or reward. 

Sponsor makes no warranties, and hereby disclaims any and all warranties, express or implied, concerning any prize furnished by third parties in connection with the Sweepstakes. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, SUCH PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND SPONSOR HEREBY DISCLAIMS ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT.

PRIZE CONDITIONS (IN ADDITION TO THOSE STATED ON THE GAME CARD OR OTHER PRIZE DOCUMENTATION, AS APPLICABLE):

In the event a winner and/or their guest engages in behavior that (as determined by Sponsor or other applicable venue representative, in their sole discretion) is obnoxious or threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person while participating in a prize-related activity, Sponsor reserves the right to terminate the trip, prize or other applicable experience early, in whole or in part, and send winner and guest home with no further compensation.

FOR PROMOTIONAL CARDS: Promotional cards shall include and herein be referenced as “promotional card(s)” collectively to any prefunded bank card, a gift card, an electronic gift card, stored-value card or certificate, a store card, merchant card, voucher for services or goods, a gift certificate or similar instrument and other redeemable instruments with value credit or the like that may be awarded are subject to terms, conditions and restrictions as set by issuer. Promotional cards are subject to the terms of use, applicable conditions and restrictions, including any expiration dates, promulgated by issuer of card. Promotional cards are not transferable, redeemable for cash or exchangeable for any other prize. Redemption of the promotional card will be subject to the standard terms, conditions and restrictions applicable to the participating merchant and or the card issuer in effect on the day of issuance of the promotional card. The promotional card cannot be redeemed for the purchase of other promotional cards. Except as required by law, the promotional card cannot be reloaded, resold, transferred for value, redeemed for cash, or applied to any other account. The Sponsor is not responsible if any promotional card is lost, stolen, destroyed or used without permission. If the promotional card is lost or stolen, it will not be replaced. No substitutions allowed except by Sponsor at its sole discretion for a prize of comparable value.

FOR TICKETED EVENTS: Any other expenses or items not specifically listed, including but not limited to, transportation, accommodations, meals, parking and souvenirs, are the responsibility of winner and/or winner’s guest(s). If a guest(s) is a minor, the minor guest(s) must be accompanied by their parent or legal guardian. Tickets are subject to certain terms and conditions as set by issuer, which may include the winner can only redeem and use the tickets via a designated mobile ticketing app. In such case, the winner must have a valid email address and a mobile device capable of downloading and running the mobile ticketing app and will be required to sign up for a free user account or log in to their account with the mobile ticketing app to access tickets. Tickets must then be scanned from winner’s mobile device for entry into venue. Individuals who do not comply with the ticket terms and conditions will be disqualified and Sponsor shall have no further obligation to such persons. Seating locations (if any) are as solely determined by Sponsor. Lost or stolen tickets will not be replaced. If the ticketed event or any portion thereof is postponed, rained out, canceled, or for other reasons beyond Sponsor’s control does not occur, the Sponsor will not be responsible for replacing the ticketed portion of prize. The Sponsor shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the venue operator, prize provider or any other persons providing any prize-related services. If travel delays, cancellations or difficulty prevent arrival in time for the event, the Sponsor is not responsible for awarding any compensation in lieu thereof. Tickets must be redeemed as stated in the prize notification or otherwise stated in the Official Rules. Winner agrees to accept all space availability requirements established by the venue. Winner and guest(s) must comply with all applicable laws, and any rules and regulations established by the venue. Winner agrees that acceptance of the prize is done so entirely upon their own initiative, risk, and responsibility.

FOR THEME-PARK/WATER-PARK RELATED PRIZES/REWARDS:BY ACCEPTING A PRIZE, WINNER ACCEPTS THE INHERENTLY DANGEROUS NATURE AND RISK IN PARTICIPATING IN ACTIVITIES IN CONNECTION WITH THE PRIZE (INCLUDING, BUT NOT LIMITED TO, THEME-PARK ATTRACTIONS AND RIDES) (“PRIZE ACTIVITIES”), INCLUDING PERSONAL INJURY AND/OR DEATH, ACKNOWLEDGES THAT HIS/HER ACCEPTANCE OF THE PRIZE IS VOLUNTARY, ACKNOWLEDGES THAT THERE ARE NATURAL FACTORS AND OCCURRENCES WHICH MAY IMPACT ON OR AFFECT THE SAFETY OF THE PRIZE ACTIVITIES HE/SHE IS PARTICIPATING IN AND HE/SHE ASSUMES THE RISK OF SUCH FACTORS AND OCCURRENCES AND AGREES THAT SWEEPSTAKES ENTITIES SHALL NOT BE IN ANY WAY RESPONSIBLE FOR ANY RESULTING INJURY AND/OR DEATH. 

HOTEL PRIZE CONDITIONS: If hotel is included in the prize package, the hotel room will consist of a double-occupancy, standard hotel room unless otherwise specified in the prize description as stated in Section 1 or at the time of prize notification. Selection of hotel is solely within Sponsor’s discretion. Winner will be required to provide credit card prior to check-in and is solely responsible for all incidental charges and may be required to sign an additional liability release for the use of the accommodations. Transportation, meals, gratuities, luggage fees, incidental hotel charges and any other expenses not specified herein are the sole responsibility of winner and guest(s). The Sponsor is not responsible for late, lost, damaged or stolen luggage.

TRIP PRIZE CONDITIONS: If airfare in included in the prize package, round-trip, coach class air transportation for winner and his/her guest(s) shall commence from a major commercial airport near winner’s home to the destination. Actual value of trip may vary based on point of departure and airfare fluctuations. Selection of airline and hotel are solely within Sponsor’s discretion. Meals, gratuities, luggage fees, incidental hotel charges and any other travel-related expenses not specified herein are the sole responsibility of winner and guest(s). Travel for the trip awarded must take place on and/or within the designated dates and is subject to schedule and availability, alternative travel dates will not be provided. If the winner(s) is unavailable for travel on the designated dates, the specified or prize will be forfeited and may or may not be awarded to an alternate winner(s) at the sole discretion of the Sponsor. Exact travel dates and arrangements may be subject to availability whether specified or not. Winner and guest(s) must travel on same itinerary. IF THE WINNER IS ELIGIBLE, BUT A MINOR IN HIS/HER STATE OF RESIDENCE, THE GUEST MUST BE WINNER’S PARENT OR LEGAL GUARDIAN. A MINOR (DETERMINED BY THE AGE OF MAJORITY IN HIS/HER STATE OF RESIDENCE) MAY ONLY ACCOMPANY THE WINNER AS A GUEST IF THE WINNER IS THE MINOR’S PARENT OR LEGAL GUARDIAN. ALL MINORS MUST BE ACCOMPANIED AT ALL TIMES DURING TRIP (INCLUDING, BUT NOT LIMITED TO, IN-FLIGHT, HOTEL STAY AND ALL PRIZE-RELATED EVENTS) BY MINOR’S PARENT OR LEGAL GUARDIAN. Guest(s) must sign and return a travel release before any ticketing of travel occurs. Winner and guest(s) must have all necessary identification and/or travel documents (e.g., a valid U.S. driver’s license) required for travel. If the trip requires traveling outside the United States, the winner, upon winning the prize, must have a valid US passport. If the winner does not have a valid US passport upon winning the prize, the trip may be forfeited and an alternate winner will be selected, in the Sponsor’s sole discretion. In accordance with applicable laws, international travelers are required to possess a government issued passport, if a winner does not have or is unable to obtain a passport within any time constraints related to the prize, the winner will be disqualified. Airline tickets are non-refundable/non-transferable and are not valid for upgrades and/or frequent flyer miles. All airline tickets are subject to flight variation, work stoppages, and schedule or route changes. If in the judgment of the Sponsor, air travel is not required due to winner's proximity to the trip destination, ground transportation will be substituted for roundtrip air travel at the Sponsor’s sole and absolute discretion. The difference in value will not be awarded to the prize winner. The Sponsor shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the air carriers, hotels, venue operators, transportation companies, prize providers or any other persons providing any prize-related services or accommodations. Additional prize award details and travel information to be provided to the winner at the time of notification. Winner and guest(s) will be required to complete and return the applicable forms and releases. Winner must sign a prize acceptance form, provide the information for their guest(s) which must be at least of the legal age of majority in their state, a W-9 form, an affidavit or verification of eligibility, and a liability/publicity release (where permitted) signed by both the winner and guest(s). Winner(s) and guest(s) are also responsible for obtaining travel insurance (and all other forms of insurance) at their option and hereby acknowledge that the Sponsor has not and will not obtain or provide travel insurance or any other form of insurance. Lost, stolen or damaged airline tickets, travel vouchers or certificates will not be replaced or exchanged. If a winner cannot be contacted or is disqualified, the Sponsor reserves the right to determine an alternate winner in its sole discretion. Unclaimed prize(s) will not be awarded. Certain travel restrictions and blackout dates may apply. Any and all airport transfers, ground transportation, meals, incidentals, gratuities, phone calls, luggage fees, travel insurance and applicable taxes (including, but not limited to all local, state and federal taxes) and any and all other expenses not specifically mentioned herein are solely the responsibility of the winner. If, for any reason, any part of the trip package is canceled or shall become unavailable, postponed or canceled, the Sponsor shall have no further responsibility for that portion of the prize and the prize will be awarded without the inclusion of the item on the same itinerary. The Sponsor is not responsible for late, lost, damaged or stolen luggage. The Sponsor is not responsible for any travel delays, flight cancellations or difficulty. If travel delays, cancellations or difficulty prevent arrival in time for any and all elements of trip, the Sponsor is not responsible for awarding any compensation in lieu thereof. Any changes to completed travel arrangements, once booked, are the sole responsibility of the winner, and are solely at the winner’s expense. All prizes or prize vouchers must be redeemed as stated in the prize notification or otherwise stated in the Official Rules. Failure to collect or properly claim any prize in accordance with these rules will result in forfeiture of the prize. If forfeited for any reason, winner will not receive any other prize substitution or compensation, and the prize will remain the property of the Sponsor and will not be awarded, except as provided herein. Winner agrees to accept all blackout dates, space availability requirements, etc. established by the Sponsor’s prize partner(s), such as hotels, airlines, trains, ships, concert or event venues etc. Winner and guest(s) must comply with all applicable laws, and any rules and regulations established by the Sponsor’s prize partner(s), if any; such as hotels, airlines, trains, ships, concert or event venues etc. Winner agrees that acceptance of any trip taken as a prize is done so entirely upon their own initiative, risk, and responsibility. BY ACCEPTING PRIZE, WINNERS ACCEPT THE INHERENTLY DANGEROUS NATURE AND RISK IN ANY TRAVEL OR TRANSPORTATION, SUCH RISK INCLUDING PERSONAL INJURY AND/OR DEATH, ACKNOWLEDGES THAT HIS/HER PARTICIPATION IN THE PRIZE EVENT IS VOLUNTARY, ACKNOWLEDGES THAT THERE ARE NATURAL FACTORS AND OCCURRENCES WHICH MAY IMPACT ON OR AFFECT THE SAFETY OF THE ACTIVITIES HE/SHE IS PARTICIPATING IN AND HE/SHE ASSUMES THE RISK OF SUCH FACTORS AND OCCURRENCES AND AGREES THAT THE SPONSOR AND RELEASED PARTIES SHALL NOT BE IN ANY WAY RESPONSIBLE FOR ANY RESULTING INJURY AND/OR DEATH.

ALL PRIZES ARE AWARDED “AS IS” AND THE SPONSOR DOES NOT MAKE (AND IS NOT RESPONSIBLE FOR) ANY REPRESENTATIONS, GUARANTEES, OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATING TO ANY PRIZE (INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE), AND ALL SUCH WARRANTIES ARE HEREBY DISCLAIMED. 

6.GENERAL.As a condition of participating, participants agree (a) that the Game Entities, their subsidiaries and affiliated companies, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents (“Released Parties”) are released, will have no liability whatsoever for, and shall be held harmless by participants against, any liability for any injuries, losses or damages of any kind to person(s), including death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of a prize or reward or participation in the Game or any Game-related activities or any travel related thereto; (b) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) all causes of action arising out of or connected with the Game, or any prize or reward awarded, shall be resolved individually, without resort to any form of class action. Sponsor is not responsible for the incorrect or inaccurate capture of information, or the failure to capture any information. Sponsor reserves the right, in its sole discretion, to disqualify any individual who is found to be tampering with the operation of the Game, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Game by cheating, deception, or other unfair playing practices, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Sponsor reserves the right to modify, extend, suspend, or terminate the Game in whole or in part if it determines, in its sole discretion, that the Game is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes beyond Sponsor’s control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the Game as contemplated herein. In the event Sponsor is prevented from awarding prizes/rewards or continuing with the Game as contemplated herein by any event beyond its control, Sponsor reserves the right to award any prizes/rewards in a manner deemed fair and equitable by Sponsor. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. The Sponsor will interpret these Official Rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Game and the Sponsor’s decisions concerning such disputes shall be final. The Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of this provision.

7.PUBLICITY. Except where prohibited, by accepting a prize, winners grant permission to Sponsor and its designees to use their names, characters, images, voices, and likenesses worldwide, in perpetuity, in any and all media now known or hereinafter invented in any and all marketing and promotional materials and waive any claims to royalty, right, or remuneration for such use. The names of the major prize winners may be included in a publicly-available winners list.

8.USE OF PERSONAL INFORMATION. Sponsor or its designated agency shall retain prize claimant’s personal data provided for prize redemption for a reasonable period of time to enable Sponsor to full fill the prize and to verify that these Official Rules have been complied with, and for accounting purposes. The data may be passed to a third party to enable such third party to fulfill any necessary requirements relating to the award of a prize or reward. Any other use of personal data will be in accordance with, and subject to, the Sponsor’s Privacy Policy at https://www.timessupermarkets.com/privacy-policy.

9.TAXES. Any valuation of the prize(s) stated above is based on available information provided to the Sponsor, and the value of any prize awarded to a winner may be reported to the IRS as required by law. Each winner is solely responsible for reporting and paying any and all applicable federal, state, and local taxes and paying any expenses associated with any prize which is not specifically stated in these Official Rules. Winners may be required to provide the Sponsor with valid identification and a valid taxpayer identification number or social security number before a prize will be awarded. Any person winning over $600 in prizes from the Sponsor in a calendar year will be issued an IRS Form 1099 reporting the value of those prizes to the IRS.

GOVERNING LAW:ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF PARTICIPANTS OR SPONSOR IN CONNECTION WITH THE GAME SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL LAWS OF THE STATE OF HAWAII WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OR CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE’S LAWS.

10.BINDING ARBITRATION. Any controversy or claim arising out of or relating to the Game shall be settled by binding arbitration in a location determined by the arbitrator as set forth herein (provided that such location is reasonably convenient for claimant), or at such other location as may be mutually agreed upon by the parties, in accordance with the procedural rules for commercial disputes set forth in the Comprehensive Arbitration Rules and Procedures of JAMS (“JAMS Rules and Procedures”) then prevailing, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The arbitrator shall be selected pursuant to the JAMS Rules and Procedures. The arbitrator shall apply Hawaii law consistent with the Federal Arbitration Act and applicable statutes of limitations, and shall honor claims of privilege recognized at law. In the event that the claimant is able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, Sponsor will pay as much of the claimant’s filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive. If any part of this arbitration provision is deemed to be invalid, unenforceable or illegal (other than that claims will not be arbitrated on a class or representative basis), or otherwise conflicts with the rules and procedures established by JAMS, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal or conflicting provision were not contained herein. If, however, the portion that is deemed invalid, unenforceable or illegal is that claims will not be arbitrated on a class or representative basis, then the entirety of this arbitration provision shall be null and void, and neither claimant nor Sponsor shall be entitled to arbitrate their dispute. Upon filing a demand for arbitration, all parties to such arbitration shall have the right of discovery, which discovery shall be completed within sixty days after the demand for arbitration is made, unless further extended by mutual agreement of the parties. THE ARBITRATION OF DISPUTES PURSUANT TO THIS PARAGRAPH SHALL BE IN THE PARTICIPANT’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN THE CLAIMS OF OTHER PERSONS OR PARTIES WHO MAY BE SIMILARLY SITUATED. DO NOT ENTER THIS GAME IF YOU DO NOT AGREE TO HAVE ANY CLAIM OR CONTROVERSY ARBITRATED IN ACCORDANCE WITH THESE OFFICIAL RULES. 

11. WINNER’S LIST. For the names of the major prize winners, send a stamped, self-addressed envelope, to: Times 75th Anniversary Scratch-Off Card Game Winner’s List Request, 801 Kaheka Street, Honolulu, HI 96814. Requests must be received within thirty (30) days after the conclusion of the Game.
